I have ben working with employer A on an H1B ( even labor and I-140 approved, PD-April2009) and planning to apply for H1 transfer now through employer B.
After the transfer is approved for B, if I change my mind and decide to continue to work with curent employer A, can I do that ?

It's only IV members. We did decide on few things last time, We have some new ideas, to talk. Obviously we need more people to carry on with the efforts...There are several private bills that are being placed in the queue as well as I see a separate bill for foreign nurses is coming up for discussion, we I feel we should talk to our lawmakers to bail us out of the EB-3/EB-2 India/china messWho other than IV is expected or invited in this call? Do we have any agenda, or just a brain storming?

I suggest we start with a parallel campaign to increase the number of IV members . Each IV member to bring in atleast one new member .
Steps to take:
Explanation : Explain, Teach /Preach or do whatever it takes to tell people about IV and what its mission is. Many people think IV is just a propaganda. SHOW them what IV has done. Tell them about the Rally Tell them about the FLower campaign . Make then visit the site
Reasoning : Make them understand that the EAD or the Labor that they are sitting on was not gotten thru some magic wand. It was thru efforts . Efforts of us IVians.
If we are able to get one person each to enroll. I am sure atleast 20 % of the new enrollees will start to understand IV and maybe contribute to it as well

i know the character as being chinese (but it's probably definately a japanese one as well). and it means to "paint/draw" so it has huge relevance to kirupa.com. as far as the stamp goes - it could be a little more interesting. it's kind of too white and plain-jane. (and what stamp costs $0.00?) the text is a little blurry as well

All taken with a Kodak DX3500, but I've not figured out how to do my edits in Photoshop without destroying the EXIF. :confused:

I got approved email within 2 weeks but still waiting for the actual forms.. Just write Expedite on the top of the cover. Again, it depends on the Immigration officer.

I am planning to work on EAD soon and switch my employer using AC21. How would USCIS know that I have switched from H1b to EAD. I might change my mind after 1 months and get back to H1 transfer and work on H1 instead on EAD.
This depends on if the future project is long term and I switch to H1B just to be safe.
Any ideas would be appreciated...

letter from the bank regarding present balance and avg balance in previous years
bank statements for the past six months

invitation letter - why they are coming here

Hi,
I know that many of us have this travel q in mind about after 485 appl travel.1..is it risk free to travel after ur 485 app(ofcourse after u get the receipt notice)but without advance parole if u have ur h1b stamped .
2...shud there be any issue at the poe regarding absent ap with pending i 485 appl?
3..can some1 be denied entry based on the above facts>?

I am no attorney... but from my knowledge you are OK.
The h1b rules state that once you loose your job, you have 10 days to find another way to keep you in status or leave the country... and your situation, even if it comes to a point where you have to agree that you were out of job for that 5 days is no problem at all.

There is no official grace period rule on H1B transfers. Having said that, you are fine since the transfer period covers your status with the previous employer as you mentioned.
It is common for people to take a week or two off in between jobs so there is no reason for you to worry.

Hi All,
My previous I-140 was denied due to the ability to pay issue since company was in loss and Idid not get prevailing wage since PD.I have appealed it hoping I can extend my h1 beyond 6th year.Is it true?
Also, Now we have pre approved labor with lower in same company where I can satisfy by showing W-2 to prove the ability to pay. Now If I am planning to apply another I-140 with labor sub,
would it matter to the new I-140 appllication if the previous I-140 was denied and is being currently appealed? Because in the I-140 form there is a question ,
"Has any Immigrant visa petition been filed by or on this person?"
Should I say "YES", Right? and also give the detail of previous filing????
Also How does USCIS verify the W2?BY contacting the IRS or ?
Please suggest?

What if the case is where I want to take up a new full time position and convert my current full time position to part time.....I guess one way to do it would be to transfer H1 to the new employer...wait for an approval and then file for another concurrent H1 for the part time job with the old company..But the problem is I'd have to wait until new approval comes...and also convince both companies to shell out 2k plus in filing fees....does any one have a better alternative ? Thanks again

Most of the RFE's for AP are for photographs if filed online. They are probably asking for latest photographs that you would need to send. It quite common.

I dont think that the USCIS can staff all the Port of Entries with officers who are well versed in every single visa type.
It can hardly be expected that a typical POE officer is aware of all the requirements and intricasies of the H1B visa; LCA, prevaling wage, bench, client/employer, paystubs, client letter etc.
Nevertheless it is possible that there might be some POE officers placed at certain places (strategically ? ) in light of recent efforts to enforce H1B and DOL regulations more stringently; especially in light of the recent report highlighting the large amount of frauds and violations in the H1B program. In that case; one should still be fine if one has long term client project, all paystubs, tax returns etc.
Is there any way Immigration voice can find out if there has been a change of policy to enforce H1B regulations at the Port of Entry? (In addition to consular interviews and applying for the H1B itself)

thank you so much for the reassurance, have been getting mixed reports of immigration officers denying re-entry, so am a little perturbed :) dont want to be stuck in a situation where i cannot re-enter :)
