Quick question on 485 processing times (I know a lot of folks have been waiting for couple of years for their processing to complete)
I checked on the USCIS website, they show that Texas and Nebraska are processing Sep/Oct 2006 cases. How can one gauge a typical processing time at USCIS for 485 applications? Any clues?

worst case
I might be the worst case so far in PIMS verification delay. I attended the interview on Dec 17th at Chennai and still have not received my passport. They asked to send the original I-797 on Jan 03. I sent it on Jan 04 and after that there is no response. It is very very aggravating.

3) MY EAD is the only problem
As i mentioned it has been almost 2 years and its still pending. i gave my biometrics at that time and i received my AP for me and my husband. My husband (dependent) got ead but not me :confused:

I think if you have I-551 stamped on your passport then you do not need any other document. i-551 is as good as physical green-card. You can carry the approval notice with you. This is my opinion, do no quote on me.

It is not popular to say so but I have this doubt too.
Currently at least there is no requirement to notify and you only need to prove you still have a similar job OFFER (not necessarily working) if and when there is an RFE.
Only good thing happened to us in last decade, as far as I can remember, is AC21 and concurrent filing.
All these immigration laws are designed to keep us indebted/bonded to the employer. They might see this as a liberating provision and try to chain us back. This may or may not happen, but just my paranoid reaction,.
Hope AC21 don't go away like labor substitution has. :(

So USCIS will never see the flowers becoz they are boxed.. and they will never get delivered becoz they are being routed from the airport itself. No major news media covered the few deliveries at USCIS.. What was the point of the campaign again?
In the past week, the "Protest Blooms" campaign notched up the following wins:
Times of India article
Buzz in the blogosphere
Attention from many attorney websites and blogs
Had a Washington Post journalist show interest in our issue and had tens of our members talk to her - which should result in a good article. How many times have we seen so many regular members of IV being able to speak to a reporter of a mainstream US publication on our issues?
Had a senior Reuters editor talk to many of us and he promised a sustained coverage of our issues
Had a senior reporter from New York Times talk to me
Had the footage of this entire event shown on CNN in India
Had many small media outlets which never cover these kind of issues, cover it (in smaller towns in MN and NY)
Created a sense of action in the community which was feeling pretty dejected after the USCIS fiasco
Had USCIS director react to us
Had so much interest generated that the IV website was brought down ;)And all this was accomplished with a severe time crunch.
Was the point of this campaign to have our flowers be decorated on the desk of the director of USCIS? I don't think so. The word again was "symbolic" and that purpose is served whether the flowers are in boxes or in full view of the world.
Would it have made for better visuals if the flowers were in full view? Sure. Is there a way to improve upon every campaign? Sure.
Like Nixstor said, lets learn from what went right and what went wrong to work on other events for the next time, instead of passing judgment and sarcastic comments from a high perch. I don�t object to your right to not participate in an event that in your view will not work. I do object to your comments which belittle the efforts of so many on this forum.

H1B petitions for intial employment where the alien was in the US: 62,292 (53%)
This is a good proxy number for H1B for applications filed by students who have studied in the US.
54% of applicants have a master's, doctorate or professional degree. 45% of applicants have a bachelor's degree
43% (a minority) of applications are from Computer Related Occupations
Median salary for H1B in computer related occupations: $60,000
Median salary for H1B in computer related occupations for initial employment: $50,000
Median salary for H1B in computer related occupations for continuing employment: $68,000
This proves that H1B employees have the power to negotiate raises and secure better working conditions as the median compensation for continuing employment is 36% higher than that for initial employment.
After seeing this data and considering the definition of median compensation, I think a good way to approach the problem of fraud is to audit all employers paying 5% below the median for the occupation.
For e.g. if the employer happened to fall into the low compensation bucket for FY 2005, then all applications from that employer for FY 2006 would face greater scrutiny.

EB categories were created for a reason, doesn't matter how smart you are. If you are in lower skill category your wait is bound to be more. I don't see anything wrong in that.
If EB1 is current and EB2 takes 4-5 years you can't just start crying. Similarly if EB2 takes 2 years and Eb3 takes 7-8 years you can't panic. Stop being a cry baby and start respecting the inter EB level priority.

Since 485 filing requires only one document from the employer (Employer's letter saying you have the job and its the same job description, see the sample format below in the second quote box), its possible to file 485 by oneself without additional help from lawyer or employer. This is a thread for that purpose. Even those who have the help and attention of a good lawyer can use this thread for guidance. This is the initial list of documents that are required for 485 filing and the optional EAD and AP filing. The fee structure is scheduled to change after July 30th. 1. Payment Checks (USCIS Filing Fees $325.00 in favor of 'United States Citizenship and Immigration Service' OR 'USCIS').

i have three question please please anyone answer ....
1 - i have previously applied but was returned due to pd not current , what to file in the form where it say if u have appllied before ? ( i am filing on my own this time )
2 - should the salary be there on employment letter . if so the present day salary or the one with labour approve ?
3 - i have an A# when my file was returned should i use that or leave it blank wherever it is asked also my wife have TIN number is that what i am supposed to write where it ask her to give her SSN
i will appreciate anyone answering any question please

I-485 DOCUMENT CHECKLIST
1. Payment Checks (USCIS Filing Fees $325.00 in favor of 'United States Citizenship and Immigration Service' OR 'USCIS').

2. Form G-28 one with each Application form. Dont need this if you are doing it on your own without the lawyer. If doing on your own, you can fill out G-28 for your spouse, if you are filling out the forms and doing paperwork for your spouse. G-28 shows that the applicant is being represented etc. If you and your spouse are both filling out your own forms and signing them then you may not need G-28 for anything.
3. Two Photographs per 1-485,1-131,1-765
4. Completed form 1-485 for Adjustment of Status
5. Completed Period of Stay form. Completed in chronological order starting with first entry into US, and all changes of status, extensions, exits and entries, down to your current status.
6. Evidence of Valid Nonimmigrant Status:
Copies of both sides of any and all 1-94 cards
Copies of all 1-797 approval notices
Copies of any and all I-20's (if applicable, both sides)
Copies of all IAP 66 forms
Copies of all PT Work Authorization Cards (if applicable)

Any guesses on number of approvals so far this month? has about 450 which i think is only a fraction of actual number

Pappu, what do you mean by "this may have delayed your greencard since July"? What is his mistake? I too have been trying all means since mid Aug. Is there something wrong with that?
Congrats ski_dude12. My personal opinion is that this may have delayed your greencard since July. Sometimes people get too anxious once their date is current and want to try everything that is possible to get approval. There is so much information and misinformation on forums.
