Good day everyone,
I am currently on H1B (company A) and am waiting for my new employer (company B) to do the transfer of my H1B. The stupid thing that I did was I gave my two weeks notice already (I have about 10 more business days left). My questions are:
1. How would the USCIS knows my last day of employment in company A? Do they know this only if employer A terminates my H1B?
2. What if I ask employer A not to terminate my H1B, at least until the actual filing (by company B) occurs?
Please advise, suggest and/or comment.

I received my daughter's and my I-797A approval notice. All information on the attached I-94s are correct, but we have same I-94# which is my daughter's old I-94#. I called USCIS 800 number. The lady who answered the phone told me that it's normal becauce my daughter is my dependent. I also went to local USCIS office. Basically they don't kown why it happened and how it happened. They say that I should send the I-797As back to the office where the approval notices are issued to see if it's an error.
Any one has this experience? Is there any problem that I use this I-94 number to file I-485 for my daughter and me which USCIS 800 says "no problem."?

Hi,
I am on L-1 Visa. My company is ready to apply green card and H1 visa as well. If my green card application is filed, then change in my visa status L1 to H1 is going to impact to my green card application?
In case I apply H1 from other employer, in that case what would be the impact on my green card application?

I had a 10 AM appointment a couple of weeks ago and I went there at 9:30 AM and the waiting room was almost full.....But by 11 AM, there were very few people left and no new people coming in..So I was wondering they dont schedule appointments after 11 AM...Maybe they have appointments afternoon...So 11 AM should be a good time to go in....I am sure there will be a lot of people in the morning hours....

I hope so but I don't tink H4 can get financial aid. If perhaps you can get your child as a parolee, there is a possibility...but there are technicalities there as well

You can scan the hard copy using a scanner to get a soft copy. If you don't have a scanner, you can use one at Fedex-Kinko store.

Hi guys, I have a unique situation, thanks to july visa bulletin. I have a EB3 labor and I 140 approved with the PD as May 2004. Recently I applied EB2 PERM in order to port the PD from EB3 to EB2. My EB2 perm is approved now. Now, I am in dilemma to choose between EB2 and EB3. I can apply EB2 I 140 and I 485 concurrently (by assuming that they will port the PD) or I can apply I485 (for previously approved EB3). Please suggest as to what route I should take.

U.S. Citizenship and Immigration Services (USCIS) has launched its newly re-designed Web site (http://www.uscis.gov/portal/site/uscis). Although the Web site update was scheduled to be introduced September 22, 2009, attorney Eugenia Ponce visited the site Monday and has this report:
The updated Web site is organized according to categories.The categories are displayed as Topics, Forms, Resources, Laws, News, and About Us. The topics are categorized as follows: Adoption, Permanent Residence, Humanitarian, Citizenship, Members of the Military and Their Family, Family, Visit the U.S., Working in the U.S, and Genealogy. After clicking on a specific topic, I was provided helpful information and even more additional information was available through the links on the left of the screen.The advantage of categorizing the information by topic is that individuals are now able to familiarize themselves with the process from start to finish. There are other helpful links and tools within each specific topic.
Another key feature to the Web site is that there is a “where to start” link. Before, individuals could navigate throughout the Web site not knowing where to even begin their search on a narrow issue. Now, the “where to start link” will allow individuals to begin their immigration search by narrowing it down to their specific issue. I was initially issued pp for 5 years in India. Last year in '08 when it was expiring, i sent application for renewal of passport (NY Consulate) based on my EAD. However, instead of renewing it for another 5 years they renewed it for 1 year only. When I called the office, they said that they receive tons of pp's lon EAD which can be renewed for a year only.
Did anybody face this same problem? Can I apply for new passport based on I-485 receipt and would they issue passport for another 5 or 10 years?

In this economy you need to generate good revenue - this is a good revenue for Indian missions'.
BTW, As far as I heard from Indian Consular Officer in Chicago - Indian Mission has a right to issue a 1 year passport, if (1) Your previous passport had < 10 yr validity or (2) you are on a temporary visa (like visiting or tourist) trying to renew it in overseas or (3) you have not stayed outside India continuously for 3 years.
Did anybody face this same problem? Can I apply for new passport based on I-485 receipt and would they issue passport for another 5 or 10 years?

If your MIL is not in the US, you cannot technically extend the visa.
My M-I-L is already in the US. She has her I94 valid unti June 7th.
I did file for an extension online yesterday. However, i am yet to mail the documents.
What i would like to know is, can she stay until we hear from USCIS about the extension getting approved/not approved?
If at all its not approved, what happens?

Big mistake. Yes, your lawful stay in US ends on 30-Sep-2007.
With the Visa from company A expiring on 30-Sep why did you travel without getting the H1 papers from company B in hand?
You should have done either of the following
1) Got H1 stamping from company B before entering US (or)
2) Entered US with company A’s VISA (before it’s expiry) and company B’s H1 approval notice, so that the officer could stamp the I-94 as per company B’s end date.
All that you can do now is to leave the country before Sep 30th and renter US with VISA stamping from company B.

H4 uses EAD and hence looses H4 status.
I-485 is denied.
Now, my understanding is that spouse has to go out of country and come back again on H4.
What about the kid?
When does the kid loose his/her H4 status? (When both mother and father use EAD)?
As long as primary stays in H status any derivative who does not change his H4 status will stay in H4 status. the only way a H4 can loose H4 status if he/she uses EAD. In your case if i have understood it correctly ur Kid will never use EAD and if you never used EAD ur H1 status is active thus ur kids H4 is active .. also i think ur wife can change her status back to H4 but would require her to file some paperwork .. she might need to geta visa stamp when she tries to re-enter into us..
