My receipt date is June 20 and my PD is Oct 2002. If the July visa bulletin does retrogress, will I still be affected with regards to I-765?
No. Since USCIS accepted your application when your PD was current, then you are fine.

Service center: WAC
Visa appointment on Feb 11 at mumbai
Documents submitted to VFS on Jan 28
On feb 11 I went to consulate and it was a long wait.. overall it took 3 hours to finish everything. When I went inside they handed over my application to me and I noticed that "Not in" was written on my DS156 form on top right corner box. here is the communication with IO
IO: so you are working for xyz company.
me: yes
IO: what are you doing for them
me: explained my role and skills
IO: are you working inhouse or at client place
me: gave client name and details
IO: till which date you are going to work for this client
me: gave details
IO: everything looks fine in your case but similar to what I have told everyone else due to the new system we need to verify your data and it will take about a week for that. (and then he wrote PIMS on my form)
me: I have a return ticket on so and so date...... can I expect before that.
IO: your case is pending only for the online verification unlike other administrative processing so it should take about a week so you should be fine.
he then gave passport back with some envelop and also one yellow paper by selecting following option in that paper
"when administrative processing is completed on your case, you will be contacted and requested to submit your passport, this letter and the accompanying envelope to the nearest VFS office."
though he selected this option, he specifically wrote PIMS on my form.
Note that PIMS problem was there for lot of cases on that day as he explicitly told me that he had to do this for lot of cases.

Very well said.
1. DOS has to move fast in May to test if there are hidden demand (ppl who missed 07/2007 filing, porting, dependent filing). Those new filing cannot get be approved before October 2011. So they can move up to Nov/Dec 2006 safely in May. Also DOS/CIS, who communicate with each other for sure, will know they should process those pre-adjudicated cased first to clear the inventory.
2. In June, July, August, they could be cautious but still move ahead up to March 2007.
3. September is critical, as that time, if DOS doesn't want to waste any quota, (100% CIS cannot approve any cased filed in that month), they have to move to a point to get all quota used. Based on 12K/half year, or 12K/year from EB1, say 20K be safe this year from EB1. 7K from EB2 ROW as last year, 8K from EB3, 0 from FB (EB2 get only 10k/4 last year as 10K FB is divided by Eb1/2/3/4), and normal 2.8K for EB2 I/C each (6K total), there are total 41K possibly for EB2 I/C.
4. Porting (6K this year), New filing (ppl who missed 07/07 with PD before 07/07), could have a negative efffect

Specially this is how DOS does for all family based CP cases. On Friday, I got SMS from USCIS that my case is updated and I should check status online. I checked my email. I was happy :) to see an email from USCIS and opened it excitedly with butterfly in stomach. Well it said..
"Your Case Status: Request for Evidence
On September 10, 2010, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires...........
"
Looks like I have to wait more :D

Are we missing another important information in the calculations here? Taken from the visa bulletin - "2. Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000. The worldwide level for annual employment-based preference immigrants is at least 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320."
For example, in the case of India, there cannot be more than 25620 [7%(226000+140000)] + 7320 [2%(226000+140000)] = 32940 green cards/year (excepting the spill-overs) inclusive of family and employment based categories (and their different quotas).
I guess, unless we get the numbers for family-based applications, similar to EB-485 that has just been released, the conclusions are based on approximations and assumptions, although I wish to point out how much I have learned and appreciate all the analysis here.
Because, if there can only be 32940 green cards for all people (family + employment) from India in a particular year(excepting the spill-overs), the employment-based green cards alone are 1960(EB4) + 1960(EB5) + 8008(EB1) + 8008(EB2) + 8008(EB3) = 27944. Does it mean that there are only 32940-27944=4996 family based green cards for India/year (excepting the spill-overs)? And also, I believe that family-based has a higher priority than employment-based as a result of which the spill-overs are larger for the former.

At least one of the big Indian outsourcers have recently done an internal audit to identify all L1s all over USA who were working under "client management". They are in the process of either sending them back to India immediately or filing H1s for them.
I heard this from one of my aquintances who was on L1 and is getting converted to H1. He was ecstatic about the new job portability that this offers him. I think it will not be an overstatement that the "bonded labor" nature of L1's enable a lot of very subtle discrimination and exploitation because both the employee and his manager knows that he has nowhere else to go. So this is a very positive step indeed.
If all the Indian companies themselves take steps to address this fraud - then that is probably the best non-disruptive solution that is there for this problem.

Guys do not feed the freeloaders by telling anything you are reading in the donor forum. I don't intent to sound rude, but why would this make your life "Suck", "no social life" , "no carreer life", "no nothing life".
Iam in the same position as everybody else, and am deeply dissapointed with the news (hence Iam here), but I just spend 2 hours in a nice pub, drinking nice micro brews, came home had a nice talk with my wife (H4), we are planning on going out for dinner and maybe watch Knocked up afterwords (heard its nice).
If this were to be true, it would delay our GC by another 2-3 years, but we are in this country on our own free will, making good money. Be dissapointed, but this is not the end of the world..Mantain the perspective...

So USCIS will never see the flowers becoz they are boxed.. and they will never get delivered becoz they are being routed from the airport itself. No major news media covered the few deliveries at USCIS.. What was the point of the campaign again?
In the past week, the "Protest Blooms" campaign notched up the following wins:
Times of India article
Buzz in the blogosphere
Attention from many attorney websites and blogs
Had a Washington Post journalist show interest in our issue and had tens of our members talk to her - which should result in a good article. How many times have we seen so many regular members of IV being able to speak to a reporter of a mainstream US publication on our issues?
Had a senior Reuters editor talk to many of us and he promised a sustained coverage of our issues
Had a senior reporter from New York Times talk to me
Had the footage of this entire event shown on CNN in India
Had many small media outlets which never cover these kind of issues, cover it (in smaller towns in MN and NY)
Created a sense of action in the community which was feeling pretty dejected after the USCIS fiasco
Had USCIS director react to us
Had so much interest generated that the IV website was brought down ;)And all this was accomplished with a severe time crunch.
Was the point of this campaign to have our flowers be decorated on the desk of the director of USCIS? I don't think so. The word again was "symbolic" and that purpose is served whether the flowers are in boxes or in full view of the world.
Would it have made for better visuals if the flowers were in full view? Sure. Is there a way to improve upon every campaign? Sure.
Like Nixstor said, lets learn from what went right and what went wrong to work on other events for the next time, instead of passing judgment and sarcastic comments from a high perch. I don�t object to your right to not participate in an event that in your view will not work. I do object to your comments which belittle the efforts of so many on this forum.

Yup, that was my point - both are greedy :)....so no point blaming any 1 party. And agree with you that foreclosure is only an option if you 'really' can't pay your monthly dues and that too for a sustained period of time - if one has the money to pay the monthly mortgage, one should continue to pay it off even if the asset value as plummeted to rock bottom because that is what you have singed in for - the amount of loan you took out to buy that house. No excuse from that!
Foreclosing just because you can't make short term profit on it is simply in-excusable.

Can USCIS stop accepting applications mid month without any notice. From the posts above, it would seem so. Everywhere else, I hear USCIS will accept applications till July 31 (with respect to July bulletin).
